What Is an FBAR?

FBAR is FinCEN Form 114, Report of Foreign Bank and Financial Accounts. If you are a U.S. person and the aggregate value of your foreign financial accounts exceeded $10,000 at any point in the year, you may have to file. It is a Treasury form, not an IRS income form, and the penalties for ignoring it are ugly. I am not your attorney. I am the person who tells clients to stop assuming "it's just crypto" means "no forms."
Who This Is For
U.S. people who used a foreign exchange, a foreign broker, or left meaningful value on a platform that is not a U.S. entity. It is not a scare page for someone whose only account is Coinbase in the United States and a hardware wallet at home. Self-custody on a device you hold is generally not "an account at a foreign bank." An account at an offshore exchange can be a different story. Confirm with a professional who reads FinCEN's current notices.
How It Actually Works
- The $10,000 test is a peak-aggregate test across foreign accounts, not a year-end snapshot of one app. A brief spike counts.
- FinCEN has treated foreign-located virtual currency accounts as potentially reportable. The facts matter: where the platform is, what kind of claim you have, whether it is an account in your name.
- FATCA Form 8938 is a cousin with different thresholds. People mix the two. The regulator guide places FinCEN on the map. The tax guide is the income side.
Risks I See in Sessions
- Using a foreign venue because fees looked cute, then ignoring the paperwork. Cheap trades plus a willful FBAR miss is a terrible trade.
- Assuming a VPN made the account domestic. It did not.
- Confusing this with 1099-DA. One is income reporting by a broker. One is you telling Treasury about foreign accounts.
When It Matters
The year you opened anything that is not clearly a U.S. platform, and every April when someone asks "any foreign accounts?" Pair with exchanges. When the number is real, pay a CPA who has filed an FBAR before.
